Only an attorney that specializes in DUI/DWI cases can answer that question. Because it would depend on all the variables with in the case. I personally would not try to handle a situation like this with out an attorney.
There are to many factors that could go one way or another is cases such as these. Like did you know that if you had a peptic ulcer it could vary your results of the breathe test. Also if you had eaten garlic that night or ate a piece of peppermint candy.
It would be in your best interest to at least talk to an attorney in your area. See what he has to say and which way he can lead you.
